1. Introduction

Welcome to iKashify ("Platform," "Service," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the iKashify Lead Management Platform.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

2. Definitions

• "Company" refers to the business entity that has subscribed to iKashify services
• "Administrator" refers to users with administrative privileges to manage company accounts
• "User" refers to any individual granted access to the Platform by an Administrator
• "Lead Data" refers to information about potential customers stored in the Platform
• "Content" refers to all data, text, files, and materials uploaded to or generated by the Platform

3. Account Registration and Access

3.1 Account Creation

• Accounts are created by authorized Company Administrators or iKashify Super Administrators
• Users cannot self-register; access is invitation-only
• Each user must have a unique account; account sharing is prohibited

3.2 Account Types

• Super Administrator: Platform-level administrative access (iKashify staff only)
• Company Administrator: Company-level management capabilities
• Standard User: Access to assigned features based on role permissions

3.3 Account Requirements

You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized access
• Accept responsibility for all activities under your account

3.4 Social Login

• Users may authenticate using third-party services (Google)
• Social login links to your existing account; it does not create new accounts
• Use of social login is subject to the third party's terms of service

4. Use of the Service

4.1 Permitted Use

The Service is intended for:

• Managing and tracking business leads
• Recording customer interactions and communications
• Analyzing sales performance and metrics
• Team collaboration on lead management
• Generating business reports and insights

4.2 Acceptable Use Policy

You agree NOT to:

• Use the Service for any illegal purpose
• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Upload malicious software or code
• Attempt to gain unauthorized access to systems
• Interfere with other users' access to the Service
• Use the Service to send spam or unsolicited communications
• Store or process data in violation of data protection laws
• Use the Service in a way that could damage or impair it
• Resell or redistribute access to the Service

5. Data and Content

5.1 Your Data

• You retain ownership of all data you upload to the Service
• You grant us a license to process your data to provide the Service
• We do not sell your data to third parties

5.2 Data Retention

• Data is retained while your Company's subscription is active
• Upon termination, data may be retained for a limited period as per our retention policy
• Deleted data may persist in backups for up to 3 months

5.3 Data Security

• We implement industry-standard security measures
• Data is encrypted in transit and at rest
• Access is controlled through authentication and authorization

6. Intellectual Property

6.1 Our Property

The Service, including:

• Software and source code
• User interface and design
• Logos, trademarks, and branding
• Documentation and content

is owned by iKashify and protected by intellectual property laws.

6.2 License to Use

We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

6.3 Restrictions

You may not:

• Copy or modify the Service
• Create derivative works
• Reverse engineer the software
• Remove proprietary notices

7. Third-Party Services

7.1 Integrations

The Service may integrate with third-party services including:

• Google Firebase: For authentication services
• Email Services: For notifications and communications
• Analytics Tools: For service improvement

7.2 Third-Party Terms

• Your use of third-party services is subject to their terms
• We are not responsible for third-party service availability or performance
• Third-party services may have their own privacy policies

8. Disclaimers

8.1 No Warranty

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY

8.2 Use at Your Own Risk

• You use the Service at your own risk
• We do not guarantee results from using the Service
• We are not responsible for business decisions made based on Service data

9. Limitation of Liability

9.1 Exclusions

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, or consequential damages
• Loss of profits, revenue, or data
• Business interruption
• Loss of goodwill

9.2 Cap

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOUR COMPANY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Termination

10.1 By You

• You may stop using the Service at any time
• Contact your Administrator to deactivate your account

10.2 By Your Company

• Administrators may deactivate user accounts
• Companies may terminate their subscription per their agreement

10.3 By Us

We may terminate or suspend access for:

• Violation of these Terms
• Non-payment by your Company
• Extended inactivity
• Legal requirements
• Service discontinuation

11. Dispute Resolution

11.1 Informal Resolution

Before filing a claim, you agree to contact us to attempt informal resolution.

11.2 Governing Law

These Terms are governed by the laws of Mysuru, Karnataka.

11.3 Venue

Disputes shall be resolved in the courts of Mysuru, Karnataka, or through binding arbitration as agreed.

12. General Provisions

12.1 Entire Agreement

These Terms, along with the Privacy Policy and EULA, constitute the complete agreement.

12.2 Severability

Invalid provisions shall be modified to the minimum extent necessary; remaining provisions continue in effect.

12.3 Waiver

Failure to enforce a provision does not waive the right to enforce it later.
